A Texas jury on August 19, 2005 awarded Carol Ernst $253.4 million on behalf of her husband, Robert, due to a wrongful death suit against Merck Pharmaceuticals. The suit claimed that the popular COX-2 Inhibitor Vioxx caused Robert to have a heart attack that caused a fatal arrhythmia, or irregular heart beat.

Experts at the United States Food and Drug Administration thought that Vioxx might be responsible for serious cardiovascular problems such as heart attack and strokes, but it was not until the jury in the Ernst case agreed that Vioxx had caused significant damage that a legal tie was established. There are over 4200 pending lawsuits against Merck, for Vioxx is believed to have caused between 88,000 and 139,000 similar cardiovascular events since it was released in 1999.
